Introduction

Welcome to the Benue State Schools EduPortal, the official education management platform for Benue State schools. These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use our Services. Your continued use of the Services constitutes your acceptance of any revisions to these Terms.

Important: Please read these Terms carefully as they contain important information about your legal rights, remedies, and obligations.

Definitions

Throughout these Terms, we use certain defined terms:

  • "EduPortal" or "we" or "us" or "our" refers to the Benue State Schools Education Portal operated by the Benue State Ministry of Education.
  • "User" or "you" or "your" refers to any individual or entity accessing or using the Services.
  • "Content" refers to any information, data, text, software, graphics, messages, or other materials displayed on or accessible through the Services.
  • "Student Data" refers to any personally identifiable information about a student maintained by a school or educational agency.
  • "Educational Records" refers to official records, files, and data directly related to a student and maintained by the school or educational agency.

User Eligibility

The EduPortal is designed for and intended to be used by the following groups:

Students

Current students enrolled in Benue State educational institutions.

Parents/Guardians

Parents or legal guardians of enrolled students.

Teachers

Educators employed by Benue State educational institutions.

Administrators

School and district administrators and staff.

Education Officials

Government officials and policymakers within the education sector.

By using the EduPortal, you represent and warrant that:

  • You are at least 13 years of age (or, if under 13, using the Services under the supervision of a parent, guardian, or school administrator).
  • You have the legal capacity to enter into binding agreements.
  • You will provide accurate, current, and complete information during the registration process and maintain and update such information.
  • Your use of the Services does not violate any applicable law or regulation.

Note for Minor Users: If you are under the age of 18, you may only use the Services with the consent and supervision of a parent, legal guardian, or school administrator.

Acceptable Use Policy

Our EduPortal is designed to support education and learning in Benue State. We expect all users to engage with our platform responsibly and ethically.

Permitted Uses:

  • Accessing educational resources and materials
  • Submitting and reviewing academic work
  • Communicating with teachers, students, and administrators
  • Tracking academic progress and attendance
  • Managing school-related administrative tasks
  • Participating in educational activities and assessments

Prohibited Conduct:

You must NOT use the EduPortal to:

  • Engage in any unlawful, fraudulent, misleading, or deceptive activities
  • Harass, bully, intimidate, or harm other users
  • Upload, transmit, or distribute viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to the Services, user accounts, computer systems, or networks
  • Interfere with or disrupt the integrity or performance of the Services
  • Collect or harvest personal information about other users without their consent
  • Post or share content that is defamatory, obscene, or violates intellectual property rights
  • Use automated scripts, bots, or other software to access the Services
  • Impersonate another person or misrepresent your affiliation with any person or entity
  • Bypass any measures we use to restrict access to the Services

Warning: Violation of these acceptable use guidelines may result in the temporary or permanent suspension of your account and access to the Services.

User Accounts and Security

Account security is crucial for protecting educational data and maintaining the integrity of our Services.

Our Actions:

  • We implement reasonable security measures to protect user accounts
  • We may lock accounts or require password resets if we detect suspicious activity
  • We reserve the right to suspend or terminate accounts that violate these Terms
  • We may remove or disable access to content that violates these Terms

Account Recovery: If you forget your password or are locked out of your account, please use the "Forgot Password" feature or contact your school administrator or our support team for assistance.

Intellectual Property Rights

The EduPortal contains a variety of content that is protected by intellectual property rights.

Our Intellectual Property:

All content, features, and functionality of the EduPortal, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, software, and the design, selection, and arrangement thereof, are owned by the Benue State Ministry of Education, its licensors, or other content providers and are protected by Nigerian and international copyright, trademark, patent, and other intellectual property or proprietary rights laws.

Limited License to Users:

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for their intended educational purposes. This license does not include:

  • Modifying, copying, or creating derivative works based on the Services or their content
  • Using data mining, robots, or similar data gathering methods
  • Downloading or copying any account information for the benefit of another party
  • Using the Services beyond their intended purpose

User-Generated Content:

You retain ownership of any content you create and submit through the Services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing and promoting the Services.

Important: Unauthorized use of materials from our Services may violate copyright, trademark, and other laws.

Privacy and Data Protection

We are committed to protecting your privacy and handling your data responsibly.

Our Privacy Policy describes how we collect, use, store, and protect personal information. By using the EduPortal, you consent to the data practices described in our Privacy Policy.

Educational Records:

We handle student educational records in accordance with applicable educational privacy laws. Access to student records is restricted to authorized individuals, such as:

  • The student
  • Parents or legal guardians of minor students
  • School officials with legitimate educational interests
  • Educational authorities for audit or evaluation purposes
  • Other parties as required by law or court order

Data Security:

We implement appropriate technical and organizational measures to safeguard your personal information. However, no electronic transmission or storage system is completely secure. While we strive to protect your personal information, we cannot guarantee its absolute security.

Service Availability and Modifications

Availability of Services:

We strive to provide reliable access to the EduPortal, but we do not guarantee that the Services will be available at all times. The Services may be unavailable during maintenance periods, technical difficulties, or events beyond our control.

Modifications to Services:

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. This includes:

  • Adding or removing features and functionality
  • Updating the user interface or navigation
  • Changing content or resources available through the Services
  • Imposing limits on certain features or restricting access to parts of the Services

Modifications to Terms:

We may revise these Terms from time to time. The most current version will always be posted on the EduPortal. Your continued use of the Services after any changes indicates your acceptance of the revised Terms.

Scheduled Maintenance: We typically schedule maintenance during off-peak hours to minimize disruption. When possible, we will provide advance notice of scheduled maintenance.

Limitation of Liability

To the maximum extent permitted by law, the Benue State Ministry of Education and its officers, employees, agents, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the EduPortal.

We specifically disclaim liability for:

  • Personal injury, property damage, lost profits, or any other losses resulting from the use of our Services
  • Unauthorized access to or alteration of your transmissions or data
  • Statements or conduct of any third party on the Services
  • Errors, omissions, interruptions, deletions, defects, delays in operation or transmission, or communication line failures
  • Computer viruses, malware, or other harmful elements that may be transmitted through the Services
  • Any decision made or action taken based on information available through the Services
  • Loss of data due to system failures, interruptions, or other technical issues

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Termination of Access

Termination by EduPortal:

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice, for any reason including, but not limited to:

  • Violation of these Terms
  • Suspected fraudulent, abusive, or illegal activity
  • Security concerns or risks
  • Extended periods of inactivity
  • Requests from law enforcement or government agencies

Termination by User:

You may discontinue use of the Services at any time. If you wish to deactivate your account, please contact your school administrator or our support team.

Effect of Termination:

Upon termination:

  • Your right to access and use the Services will immediately cease
  • We may delete or archive your account and associated data
  • Certain provisions of these Terms will continue to apply even after termination

Governing Law and Dispute Resolution

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.

Jurisdiction:

Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be instituted exclusively in the courts located in Benue State, Nigeria, and you consent to the personal jurisdiction of such courts.

Dispute Resolution:

Before filing a claim against EduPortal, you agree to attempt to resolve the dispute informally by contacting us. If a dispute cannot be resolved informally, either party may initiate formal proceedings.

Miscellaneous Provisions

Severability:

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

No Waiver:

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by an authorized representative of the Benue State Ministry of Education.

Assignment:

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without your consent.

Entire Agreement:

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and the Benue State Ministry of Education regarding your use of the Services and supersede all prior agreements and understandings.
